Trademark and Copyright Guidelines
These guidelines are for Virtual Computer licensees, authorized resellers, developers, customers, partners, and other parties wishing to use Virtual Computer’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging.
Virtual Computer’s trademarks, service marks, trade names, and trade dress are valuable assets. By using a Virtual Computer trademark, in whole or in part, you are acknowledging that Virtual Computer is the sole owner of the trademark and promising that you will not interfere with Virtual Computer’s rights in the trademark, including challenging Virtual Computer’s use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any Virtual Computer trademark. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise.
Authorized Use of Virtual Computer Trademarks
1. Advertising, Websites, Seminars, Promotional, Sales Materials: Only Virtual Computer and its authorized distributors, resellers, partners and licensees may use the Virtual Computer Logo. The Virtual Computer logo may only be used as it appears on the Virtual Computer website. Attributions of ownership of Virtual Computer trademarks must be made to Virtual Computer including the fact that NxTop® and Virtual Computer® are registered trademarks of Virtual Computer, Inc.
The use must reflect favorably on both Virtual Computer and Virtual Computer products or technology, and Virtual Computer must be notified of the use. In cases of websites, a link must be provided to the Virtual Computer website.
2. Merchandise Items: You may produce and give-away merchandise items, such as T-shirts and mugs, bearing Virtual Computer or NxTop trademark, including symbols, logos, or icons, so long as you do not charge for the items and that you comply with Section 1 above.
Unauthorized Use of Virtual Computer Trademarks
1. Company, Product, or Service Name: You may not register or attempt to register, in whole or in part, Virtual Computer, NxTop, any variation of NxTop, Virtual Computer-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name without prior written approval from Virtual Computer.
2. Variations, Takeoffs or Abbreviations: You may not use a variation of the Virtual Computer logo for any purpose. You may not use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a Virtual Computer trademark for any purpose without prior written approval from Virtual Computer.
3. Disparaging Manner: You may not use a Virtual Computer trademark or any other Virtual Computer-owned graphic symbol, logo, or icon in a disparaging manner.
4. Virtual Computer’s Trade Dress: You may not imitate the distinctive Virtual Computer packaging, web site design, logos, or typefaces without prior written permission from Virtual Computer.
5. Domain Names: You may not register or use an identical or virtually identical Virtual Computer trademark as a website domain name.
6. Spelling & Capitalization: You must spell and capitalize Virtual Computer’s trademarks exactly as they are shown on the Virtual Computer website.
